Pharmaceutical Recall Lawyers

Manufacturers and/or retailers sometimes recall drugs and medical devices voluntarily. In other cases, the Food and Drug Administration (FDA) forces a recall. If a drug or device has been recalled, it may have been found to be a dangerous drug for some reasons, for at least some people.

Recalled Drugs

Drugs that have been recalled by the FDA in the last two years due to unacceptable side effects or contamination of specific lots include:

  • OMONTYS® (peginesatide) injections manufactured and distributed by Affymax, Inc. (Nasdaq: AFFY) and Takeda Pharmaceutical Company Limited (Takeda)
  • Sterile products manufactured and distributed by Clinical Specialties

If you have suffered serious injury in New Jersey after taking a medication that was later recalled, talk to one of our experienced pharmaceutical recalls attorneys at Britcher Leone, LLC, about a potential injury claim on your behalf. A list of recalled drugs can be found on the FDA website at http://www.fda.gov/Drugs/DrugSafety/DrugRecalls/default.htm

Defective Medical Devices

On the other hand, medical devices can also have a faulty design or be improperly manufactured or distributed. In 2012, RAM Medical Inc., a medical supply company based in Wayne, New Jersey, was ordered by the U.S. attorney's office to pay $173,000 in fines and restitution after selling counterfeit and contaminated surgical mesh. If you have reason to believe that you might have had surgical mesh sold by this company implanted in your body in a hernia repair operation, contact an attorney. This is but one example of the type of case that Britcher Leone, LLC, is prepared to investigate and litigate on behalf of clients with legitimate claims.

It is always a wise idea to consult with a lawyer after consuming a medication or receiving a surgical implant or device that has been recalled. Even if you have not yet suffered injury, you may have legal recourse by way of a consumer fraud lawsuit. The New Jersey Consumer Fraud Act or a similar consumer protection act (CPA) in any state may be relevant to your case. Our personal injury law firm can collaborate with, and refer clients to, a well-respected consumer fraud law firm in such a case.
