Wrongful
death occurs when the negligence of another causes the death of an
individual. Wrongful death can occur as a result of an automobile
accident, an unsafe product, medical malpractice, unsafe premises
and other situations where a person’s negligence causes fatal
injuries. Wrongful death claims specifically provide compensation to
the dependents of the deceased for the economic losses suffered as a
result of the death, which are determined by the family status of
the victim, the annual income being made, the number of individuals
financially dependent on the individual, and the age of the victim.
In addition to provable economic losses that the victim’s dependents
will suffer, damages for the pain and suffering of the injured
individual prior to death are recoverable.
